LIABILITY WAIVER

Effective Date: 1st January 2026

By accessing, registering for, purchasing, or participating in any online yoga classes, live sessions, recorded videos, workshops, or related content (collectively, the “Classes”) provided by Gather-Life LLC, referred to herein as ‘Gather via Gather-life.com, you acknowledge and agree to the following:

1. Voluntary Participation

Your participation in the Classes is voluntary. You are solely responsible for determining whether participation is appropriate for your physical, mental, and emotional condition.

2. Assumption of Risk

You understand that yoga, movement, breathwork, meditation, and wellness practices involve inherent risks, including but not limited to muscle strain, joint injury, falls, dizziness, emotional discomfort, or aggravation of pre-existing conditions.

You knowingly, freely, and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, arising from your participation.

3. Health & Medical Disclaimer

You acknowledge and agree that:

  • You are responsible for consulting a qualified healthcare professional before participating if you have any medical concerns.

  • You have no condition that would make participation unsafe, or you choose to participate despite such conditions at your own risk.

  • The Classes are not medical, therapeutic, or healthcare services and do not replace professional medical advice, diagnosis, or treatment.

4. Online Instruction & Personal Environment

You understand that:

  • Classes are delivered online, and instructors cannot physically observe or correct your movements.

  • You are responsible for maintaining a safe and appropriate practice environment, including adequate space, suitable flooring, equipment, and reliable technology.

  • You will stop participating immediately if you experience pain, dizziness, or discomfort.

5. Release of Liability

To the maximum extent permitted by applicable law, you release, waive, discharge, and hold harmless Gather, Gather-life.com, and all instructors, employees, contractors, affiliates, and representatives from any and all claims, liabilities, damages, losses, or causes of action arising out of or related to your participation in the Classes, including claims based on negligence.

Where liability limitations are restricted by law, this release applies only to the fullest extent permitted.

6. Indemnification

You agree to indemnify and hold harmless Gather from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your participation in the Classes or your breach of this agreement.

7. No Guarantees

You acknowledge that Gather makes no guarantees regarding physical, mental, emotional, or other outcomes from participation in the Classes.

8. Intellectual Property

All content provided through the Classes is the intellectual property of Gather and may not be recorded, copied, reproduced, distributed, or shared without prior written consent.

9. International Participation & Governing Law

You acknowledge that you may access the Classes from outside Gather Life’s home jurisdiction and are responsible for complying with local laws and regulations.

This agreement shall be governed by the laws of the State of California, unless mandatory consumer protection laws in your country of residence apply.

10. Age & Legal Capacity

You confirm that:

  • You are at least 18 years of age, or you have the consent of a parent or legal guardian.

  • You have the legal capacity to enter into this agreement.

11. Acceptance

By checking a box, clicking “I Agree,” registering, purchasing, or participating in any Class, you confirm that you have read, understood, and agree to be legally bound by this Liability Waiver & Release.
